Federal Judge Orders Freedom of Abrego Garcia from ICE Detention

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge stated in her ruling.

The case originates in a mistaken removal to El Salvador in March, which the government later admitted was an mistake. After his repatriation to the United States to answer human smuggling allegations, he was held in federal custody.

In her order, the judge noted that the authorities lacks a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The legal proceedings involve disputed claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in the state of Tennessee.

Terms of Release

The judge, who was hearing his petition to removal in a federal court, determined that he must now adhere to the conditions of his release from jail in Tennessee. This order shifts his monitoring to the jurisdiction handling his criminal case.
